Terms of Service

These Terms of Service ("Terms") govern your use of winecountryinvestments.net (the "Site") and your communications with Wine Country Investments & Real Estate Acquisitions LLC ("Wine Country Investments," "we," "us," or "our"). By using the Site or contacting us, you agree to these Terms. If you do not agree, please do not use the Site.

1. Who We Are

Wine Country Investments purchases real estate as a principal, for its own account. We are not a licensed real estate brokerage. We do not act as an agent for buyers or sellers, provide brokerage services, or charge commissions. In some transactions we may assign our purchase contract to another buyer; when we market a contract, we market our contractual interest and disclose in writing that we do not hold legal title.

2. No Offer, Advice, or Guarantee

Nothing on the Site is an offer to purchase any property. Any offer we make is made only after we review the property and is subject to a written purchase agreement signed by both parties. Statements on the Site about timelines, offer ranges, or process are general descriptions of how we work and are not commitments in any specific case.

Nothing on the Site is legal, tax, financial, or investment advice. You should consult your own attorney, accountant, or advisor before making decisions about your property.

3. Inquiries and Communications

When you submit an inquiry or otherwise contact us, you represent that the information you provide is accurate and that you are authorized to discuss the property in question. You agree that we may contact you by phone, email, and, if you have consented, by text message, to respond to your inquiry and discuss a potential transaction. Our text messaging program, including how to opt out, is described in our Privacy Policy.

4. Acceptable Use

You agree not to use the Site to submit false or misleading information, to interfere with the Site's operation or security, to scrape or harvest content or contact information, or for any unlawful purpose.

5. Intellectual Property

The Site, including its text, design, and the Wine Country Investments name and mark, is owned by us and protected by applicable law. You may view the Site for your own informational use. You may not copy, reproduce, or distribute Site content without our written permission.

6. Third Party Links and Services

The Site may link to or rely on third party services, such as our form and hosting providers. We are not responsible for the content or practices of third parties.

7. Disclaimer of Warranties

The Site is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any warranty that the Site will be uninterrupted, error free, or free of harmful components, and any implied warranties of merchantability or fitness for a particular purpose.

8. Limitation of Liability

To the fullest extent permitted by law, Wine Country Investments and its members, managers, and agents will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Site or your communications with us. Our total liability for any claim arising out of the Site will not exceed one hundred dollars ($100). Nothing in these Terms limits liability that cannot be limited under applicable law, and nothing in these Terms modifies the terms of any written purchase agreement we may enter into with you.

9. Indemnification

You agree to indemnify and hold us harmless from claims, losses, and expenses, including reasonable attorney fees, arising from your breach of these Terms or your misuse of the Site.

10. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to its conflict of law rules. Any dispute arising out of these Terms or the Site will be brought exclusively in the state or federal courts located in Sonoma County, California, and you consent to the jurisdiction of those courts.

11. Changes to These Terms

We may update these Terms from time to time. The effective date at the top reflects the most recent version. Continued use of the Site after a change means you accept the updated Terms.
